SameTone Video Upload Terms
Effective date: October 12, 2026. Version: 2026-10-12.
Service provider
SameTone is provided by Paradnik Andrei Sergeevich, acting as an individual. For questions about video uploads and use of materials, contact [email protected].
When these terms apply
These terms govern the preliminary transfer of a video to SameTone, its technical checks, and its temporary storage before you register.
Before sending a file, you review these terms and confirm that you have the necessary rights. You accept these terms by an explicit confirmation in the interface before the file transfer begins. Selecting a file that remains on your device does not, by itself, send it to SameTone.
Preliminary uploads are available to people aged 18 or older. By accepting these terms before sending a file, you confirm that you are at least 18.
What confirming your rights means
By confirming your upload rights, you state that you have a lawful basis to transfer the selected video to SameTone and authorize the activities described below. This may be based on your own rights, permission from a rights holder, a suitable license, or another basis provided by applicable law.
Your confirmation covers the entire file, including video footage, photographs, music, other sound recordings, speech, and third-party materials.
You confirm the following:
- Rights to transfer and store. Your rights or permissions cover transferring the file to the service and making technical copies needed to receive, check, and temporarily store the video. If a license restricts how the material may be used, those restrictions are respected.
- Rights of people in the video. Transferring the file and processing it at this preliminary stage do not violate people's image, voice, or privacy rights. Where permission from a person or their legal representative is required, you have obtained it. Applicable legal requirements apply to videos involving minors.
- Authority to act for others. If you upload on behalf of an employer, client, or another rights holder, you are authorized to transfer the material to the service and grant permission for the specified activities.
- Compliance with access restrictions. Transferring the file does not breach confidentiality obligations, an agreement with a client or employer, or other applicable restrictions on disclosing its contents.
You retain the rights you hold. Your confirmation records your statement that you have the necessary rights and authority. It does not itself create rights to someone else's material.
What does not establish rights on its own
Having a file on your device, finding a video online, buying a copy, or being able to download it does not, by itself, establish a right to transfer it to the service. Crediting an author does not, by itself, replace the required permission.
You may have filmed a video while using someone else's music, photographs, or performances in it. In that case, you must consider the rights to those elements and the rights of people in the recording.
A client's permission to publish a video does not necessarily cover transferring it to a third-party service. Check the scope of your authority. If you cannot confirm the necessary basis for uploading, obtain permission or choose different material.
Upload security
Do not upload intimate images or videos of a person without that person's consent, including AI-generated or synthetic material.
You must not use uploads to transmit malicious code, disrupt the service, access other people's files, or bypass technical restrictions and security mechanisms.
SameTone may reject or suspend an upload, or restrict access to an uploaded file, if the file does not meet technical requirements, there are signs of a security threat, or there is substantiated information that rights to the material have been violated. Where possible, we provide the reason for a restriction and a way to contact us. Questions about restrictions can be sent to [email protected].
What you authorize SameTone to do
By accepting these terms, you grant SameTone a limited, non-exclusive license to:
- receive the file and make technical copies needed for its transfer and storage;
- check its format, size, accessibility, and technical suitability for further use;
- investigate specific security threats and substantiated rights complaints, only to the extent needed to examine the relevant upload;
- temporarily store the file and related technical upload information;
- link the uploaded file to your account after registration;
- delete the file and temporary copies under the applicable retention rules.
This permission extends to SameTone's infrastructure and storage providers only to the extent necessary for these activities. Information about providers and personal data processing is disclosed in the Privacy Policy before upload.
This license does not transfer ownership of the materials to SameTone or grant permission to publish them, use them in advertising, or sell them. Publishing uploaded material in advertising, portfolios, or public examples requires your separate consent and respect for the rights of other people in the material. The uploaded file, its contents, and technical copies are not used to train models by SameTone or its AI providers.
Uploading before registration does not start translation or speech synthesis. Permission for the preliminary upload does not cover creating a translation or reproducing a voice in synthetic speech.
Personal data and file deletion
A video may contain people's personal data even if the uploader has not registered. Receiving and storing such a file may already constitute processing of personal data.
Before sending a file, you can read the Privacy Policy through the link in these terms. It describes processing purposes and grounds, data recipients, SameTone's obligations, and ways to contact us about data. You acknowledge that you have read the Privacy Policy. Accepting these terms is not blanket consent to any processing of personal data and does not replace separate consent where required by law.
The Privacy Policy governs retention and automatic deletion periods for anonymous videos, when those periods begin, deletion on request including backups, and permitted exceptions.
For questions about rights to uploaded material or data deletion, contact [email protected].
What happens at registration
At registration, you separately accept the main SameTone Terms of Use. From that point, they govern your account and further work with your materials, including an earlier upload: permission for translation and speech synthesis, use of results, payment, and other service features. The requirements in these Upload Terms concerning the lawfulness of a preliminary upload already made continue to apply.
If you do not register, these terms continue to govern the upload already made and the subsequent storage and deletion of the file. Not registering does not remove the requirements concerning lawful transfer of the material.
